Can I Reverse a Lifetime License Suspension?

Indiana law concerning driver’s license suspensions used to be significantly stricter when it came to lifetime suspensions, and many people who were adjudicated as habitual violators could receive a lifetime suspension of their license without clear options for contesting the lifetime suspension or attempting to have it reversed. To be clear, a lifetime suspension of a driver’s license used to mean just that — that the person’s driver’s license was suspended for the remainder of their lifetime. However, in 2014, Indiana law changed, and habitual violators could no longer receive a lifetime suspension of their driver’s license — only a maximum of a 10-year driver’s license suspension.

While that change to the state’s law prevented anyone adjudicated as a habitual violator from 2014 onward from receiving a lifetime suspension of their driver’s license, it did not change the fact that people in Indiana had existing lifetime license suspensions that, for many, remain in place. Understanding License Suspensions for Habitual Violators 

Under IC 9-30-10-4, drivers who are adjudicated as habitual violators (meaning that they have received multiple serious traffic violations within a certain period of time, and/or have been involved in a traffic offense that has resulted in serious bodily harm or death to another person) can face a range of penalties that include a lengthy driver’s license suspension.

Depending on the type of traffic violations or criminal charges related to the traffic case, the maximum amount of time that a person can face for a driver’s license suspension is 10 years. However, as we noted above, before that date, certain habitual violators could receive a lifetime license suspension. With the change to the law concerning driver’s license suspensions from 2014 onward, Indiana law also made it possible for those with lifetime license suspensions to become eligible to drive again.

How to Terminate Your Lifetime Driver’s License Suspension 

To be clear, not all people with a lifetime driver’s license suspension can be eligible to have that suspension terminated. In order to have your lifetime license suspension terminated, both of the following must be true:

  • You received your lifetime license suspension at least 10 years ago; and
  • Act(s) that led to your lifetime license suspension did not involve leaving the scene of an accident where a person died or resulted in another person’s death.
