What is Drugged Driving?
A person can be charged with driving under the influence of drugs by having virtually any drug in their system. This is a broad charge that can be caused by any of the following drugs:

- Any illegal drug or controlled substance
- Over-the-counter medicine
- Prescription medication

For a second offense, a person will face 60 days in jail and a fine of up to $500. At a minimum, the person must serve at least five days in jail or 240 hours of community service. In addition, the driver’s license will be suspended for one year. When a person is charged with two OWI offenses within a seven-year period, the charge is elevated to a felony OWI, which comes with more severe penalties.
In addition to the above penalties, all drugged driving convictions require an alcohol and drug assessment. The person may be required to complete a treatment program.
